Privacy Notice

This Privacy Notice describes the information Temptu, Inc. (“Temptu”, “we”, “our”, or “us”) collects, how we use and retain this information, with whom we share it, and the choices you have in connection with these activities. This Privacy Notice applies to the Temptu’s website (https://temptu.com/) (“Website”), our Pro Membership program (“Pro Membership”), and our services (collectively, our “Services”).

  1. PERSONAL INFORMATION WE COLLECT FROM YOU AND HOW WE USE IT

    When you interact with the Services, we collect or receive your personal information, as described below:

    • Apply for a Pro Membership. When you apply for a Pro Membership through the Website, we will collect your identifiers (name, email address, telephone number, physical address, chosen password), employment information (job title/description, letter of employment, proof of credentials, certification, and/or license). We will use this information to review your application for Pro Membership, and communicate with you about your application and membership (if you are approved).
    • Participate in Workshops, Events, and Tradeshows. To participate in a Workshop, we will collect from you your identifiers (name, email address, and cell phone number). We will use this information to register you for the Workshop, communicate with you about the Workshop, and send your Certificate of Completion (if applicable). Your identifiers will be shared with TimeTap, to facilitate scheduling the Workshop. TimeTap’s handling of your information is subject to its Privacy Policy and Terms of Service – this Privacy Notice and our Terms of Service do not govern TimeTap’s use of your information.
    • Join the Temptu Pro Brand Ambassador Program or Affiliate Program. We use Impact (f/k/a “Impact Radius”) to facilitate our Brand Ambassador Program. Impact’s use of your personal information is subject to the Impact Privacy Policy and Terms of Use. This Privacy Notice does not govern Impact’s handling of your personal information. Temptu does not have access to the personal information that you provide to Impact other than identifiers (name, name of company, email address, business phone number, and cell phone number).
    • Leave a comment in our blog. When you leave a comment on our blog, we will collect your account information, and anything you provide in the content of your comment. We will use this information to review the comment, and post it to the Website, which is publicly available.
    • Log in to your account. When you log in to your account, we will collect your identifiers (email and password). We will use this information to authenticate you to your account.
    • Purchase products or services. When you purchase a product or service (e.g., a Workshop), we will collect from you your identifiers (name, email address, phone number, billing address, and shipping address), and as described below.
    • Payment processors. This Privacy Notice does not govern these payment processors’ handling of your personal information, which are subject to their individual privacy policies and terms of use or service. When you use PayPal’s Braintree, we will collect your identifiers (name, billing address, shipping address, phone number (optional)) and the last four (4) digits of your payment card. When you use Shopify Payments, we will collect your identifiers (name, billing address, shipping address) and the last four (4) digits of your payment card. When you use Sezzle, we will collect your identifiers (name, shipping address, and billing address). We collect this information to track and ship your order. If you use Shop Pay or Gpay (Google Pay), we will collect your name and shipping address. Please refer to the Google Payments Privacy Notice and Google Privacy Notice for more information. Please refer to the Shopify Privacy Policy and Shopify Payments Terms of Service for more information. Please refer to the Paypal Privacy Statement, Paypal Statement on Cookies and Tracking Technologies, and User Agreement for more information.     • If you leave unpurchased products or services in your cart, we will use your email address to notify you that you have unpurchased products or services in your cart. You can unsubscribe at any time by clicking on the “unsubscribe” link in each email. Please note that we will continue to send you notifications necessary to the Services.
    • Share your look. When you tag Temptu in a social media post on your social media page (@TEMPTU and #TEMPTU), we will be notified, and, as part of the functionality of social media platform, the tagged picture will be automatically added to our social media platform photo gallery. If we wish to add the tagged photo to our organic social media channel, with your permission, we may feature your post on our website or social media account.
    • Participate in social media. If you interact with our social media pages, we may collect personal information you choose to disclose including personal identifiers (name, social media handle, and email address) and visual information (your social media photo or your photograph). When you interact with our fan page on social networking websites (each a “Fan Page” and collectively “Fan Pages”), such as TikTok, Facebook, LinkedIn, YouTube, and Instagram (the “Social Networks”), we collect basic engagement metrics and use it to tailor content and marketing and use it to improve user experience as set forth in this section. Please note that we do not control the use or storage of the information that you have posted to any social networking websites. This information is collected and processed by the social networking websites for their own purposes, including marketing. For more information on how Social Networks use your personal information, please see TikTok’s Privacy Policy, Facebook’s Privacy Policy, YouTube’s Privacy Policy, LinkedIn Privacy Policy, and Instagram’s Privacy Policy.
      • Fan Pages. When interacting with our Fan Pages, we collect, from you, your personal identifiers (first and last name) and visual information (photograph (i.e., profile picture)), as well as any information that you provide when interacting with our Fan Pages (e.g., commenting, sharing, and rating). We use this information to advertise our products, for events and invitations, and to communicate with users via the contribution and comment function. Because our Fan Pages are publicly accessible, when you use them to interact with other users, for example by posting, leaving comments or liking or sharing posts, any personal information that you post in them or provide when registering can be viewed by others or used by them as they see fit. The content posted on our Fan Pages or other public areas of social networking websites can be deleted in the same way as other content that you have created. If at any time you want content posted to be deleted, please email your request to us at customercare@temptu.com.
      • Community Management. We collect, from you, your contact, including "likes", shares, messages and other interactions with the content, in order to analyze and evaluate how our content is perceived, to learn from it, and to improve our public relations efforts. We use this information to create advertisements that match our Fan Page and to disseminate them via the Social Network based on demographic data.
      • Surveys. When you participate in a survey on our Fan Pages, we collect, from you, your personal identifiers (email address), your internet or other electronic network activity information (device and browser data, IP address, location information based on the IP address), log data (IP address to determine whether a respondent has previously participated in a survey), and metadata (usage patterns)). We use this information to analyze and process the results of our surveys for market research purposes.
      • Contests or Sweepstakes. When you participate in a contest or sweepstakes on our Fan Pages, we collect, from you, your personal identifiers (name, email address, telephone number, and physical address (if provided)), and your visual identifiers (photograph (i.e., profile picture)). We use this information to manage your entry, communicate with you about your entry, and to run the sweepstakes or contest. We also use this information to create unique offers to enhance your customer experience. If it is necessary to send non-cash prizes, we will forward your information to a shipping service provider.
      • Events and Photos. When you register for an event on our Fan Pages, we collect, from you, your personal identifiers (first and name, email address, telephone number, physical address, and any other information you provide). We use this information to create and manage the event (e.g., to create the guest list, accreditation and admission control, room and personnel planning, planning the catering) as well as to send you your invitation and notifications about the event. We also use this information for prevention of fraud and defense against legal claims. At events for which you have registered, photos and video recordings may be made (possibly by a photographer commissioned by us), in which you may also be shown. If you are the central subject of a recording, the photographer will ask you before the recording/taking the photo whether you agree and consent. We use the photos for our public relations and marketing on our various media/digital media outlets.
      • Messenger Functionality. When using messenger functionality on Social Networks, Social Networks collect, automatically, your internet or other electronic network activity information (IP address, date and time of the server request, time zone, specific browser or app function, access status, amount of data transferred, browser or app from which the request comes, device type, operating system used, and its interface (e.g., Android or IOS), language, version of the operating system, and device identifiers). We do not use this information; its use is governed by the respective Social Networks’ privacy policies (linked above).
      • Page Insights. When you visit our Social Network Page, the Social Network records your IP address and other information about your usage behavior on our Social Network Fan Page. The Social Network collects, through trackers in the browser of your device or via the advertising ID (IDFA from Apple or GAID from Google), when you open the Social Network app through your mobile device (e.g., smartphone or tablet). Social Network uses this information to provide us with statistical evaluations of the use of our Social Network Fan Page. We receive this information directly from Social Network, in the form of aggregated data and anonymous statistics regarding certain data points, such as: age; gender; city/country; device; inquiries from fans about other Social Network fan pages; region and language settings of the users; proportion of men and women; the number of people reached; clicks on posts, "Likes” and reactions; comments and shared content; and total video views. We use this information to analyze and improve the advertising campaigns we conduct through our Social Network Fan Page. We do not collect or process any other Personal Information in connection with Social Network “Page Insights” function. We do not retain this information independently. For information on data protection and the storage period on the Social Network in relation to its Insights function, see the Social Network privacy policy linked above. It has been contractually agreed with the Social Network that the Social Network is responsible for providing you with information about the processing for Page Insights.
    • Information Processed Solely by Social Networks. We do not know how the Social Networks use personal information for its own purposes, how long the personal information is stored on the Social Network or whether the Social Network data is passed on to third parties. If you are currently logged in to a Social Network as a user, the Social Network automatically collects, through trackers on your device, your Social Network ID or a link between the Social Network ID and the advertising ID (IDFA from Apple or GAID from Google) when you open the Social Network app through your mobile device (e.g., smartphone or tablet). This enables the Social Network to understand that you have visited our Social Network Fan Page along with other Social Network pages that you have clicked on, whether you clicked on Social Network buttons integrated into websites that partner with the Social Network, and other online interactions that report user data to the Social Network. Based on this data, content or advertising tailored to you can be offered. You can find more information about the personal information collected by Social Networks, how it is used and how long it is stored by visiting the Social Network’s privacy policies, linked above.

    • Sign up for our marketing emails and exclusive offers. When you subscribe to our marketing emails and exclusive offers, we collect your personal identifiers (name, email address). We use this personal information to fulfill your request to receive email communications regarding promotions and exclusive offers. We will share your identifiers (name and email address) with our email marketing service provider to send you the marketing emails. You can unsubscribe at any time by clicking on the “unsubscribe” link in each email. Please note that we will continue to send you notifications necessary to the Services or requested products or services. Our communications contain tracking technologies, to analyze whether a predefined action took place by a recipient, such as opening our communications, in order to better adapt and distribute our communications. You can disable tracking by disabling the display of images by default in your email program.
    • Text Marketing and Notifications. By entering your phone number in the checkout and initiating a purchase, subscribing via our subscription form or a keyword, you agree that we may send you text notifications (for your order, including abandoned cart reminders) and text marketing offers. Text marketing messages will not exceed ten a month. You acknowledge that consent is not a condition for any purchase. If you wish to unsubscribe from receiving text marketing messages and notifications reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you with in any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests will not be accounted as a reasonable means of opting out. Message and data rates may apply. For any questions please text HELP to the number you received the messages from. You can also contact us for more information. If you wish to opt out please follow the procedures above.
    • Contact Us. When you contact us by email, chat bot, or text message, we will collect your identifiers (name, telephone number, and/or email address) and any information you disclose in your communication to us. We use this personal information to respond to your questions or inquiries, troubleshoot as necessary, and address any issues you have with our Services. We will share this personal information with our third-party customer service provider to assist us with handling customer service requests and our customer relationship management platform provider. Our communications will be shared with our e-mail communications, text message, or chat bot provider (as applicable) to facilitate our assistance and communication with you.
    • Aggregate data. We aggregate the data we collect for benchmarking purposes and for internal analytics.
    • Information Collected Automatically by Cookies. In addition to the personal information you provide, when you use our Website, we collect information automatically via cookies and similar technologies as your use our Website. This includes the following internet or other electronic network activity information: 
    • We use essential, performance, marketing, and analytics cookies to collect your usage, device, and location information when you interact with the Website. We use this information to: (i) track you within the Website; (ii) enhance user experience; (iii) conduct analytics to improve the Website; (iv) prevent fraudulent use of the Website; (v) diagnosis and repair Website errors, and, in cases of abuse, track and mitigate the abuse; and (vi) provide targeted advertising.

    Particular third-party cookies to note on our Website include:

      Google Analytics. We use Google Analytics to collect information on your use of our Website to improve our Website. In order to collect this information, Google Analytics may set cookies on your browser, or read cookies that are already there. Google Analytics may also receive information about you from applications you have downloaded that partner with Google. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to our Website is restricted by the Google Analytics Terms of Use and Privacy Policy. To prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser add-on.
    • Meta Pixel. We use Meta Pixel to serve you ads on your social media based on your browsing behavior. Meta Pixel sets a cookie on your device that allows your behavior to be tracked after you have been redirected to the Website by clicking on a Facebook ad. This enables us to measure the effectiveness of Facebook ads for statistical and market research purposes and to provide targeted advertising. We do not have access to the information collected through the Meta Pixel. The information collected via Meta Pixel is stored and processed by Meta. Meta may link this information to your Facebook account and use it for its own promotional purposes in accordance with Facebook's Data Usage Policy.
    • TikTok Pixel. We utilize TikTok Pixel to collect information about how users interact with our Services. We use this information to serve targeted ads based on users’ interaction with our Services and to measure the performance of our advertising campaigns conducted through TikTok. Please review TikTok’s Privacy Policy for additional information on how TikTok uses the information it collects.
    • Pinterest Pixel. We utilize Pinterest Pixel to collect information about how you interact with our Services. We use this information to serve targeted ads based on your interaction with our Services and to measure the performance of our advertising campaigns conducted through Pinterest. Please review Pinterest’s Privacy Policy for additional information on how Pinterest uses the information it collects. You can opt out of online behavioral advertising through their Pinterest personalization settings, the AdChoices website optout.aboutads.info, or your mobile ad identifier settings.
    • Google Ads. We utilize Google Ads to serve ads based on user’s prior visits to the website. Each visitor to our Website receives a different cookie, and the information collected by the cookie is used to generate conversion statistics and allows us to see the total number of individuals who clicked on our ads. Google Ads enables Google and its partners to serve ads to you based on your visits to our Website in addition to other websites on the Internet. Please review Google’s Privacy Policy for additional information on how Google uses the information collected. To opt out of targeted advertising by Google and this sharing, you can go to Google’s Ad Settings or you can install the DoubleClick opt-out browser plugin.
    • Adobe Analytics. We utilize Adobe Analytics to collect information on your interaction with our Services, including your web browsing activity, device information, IP address (which may be used to approximate your general location), the URL of the web page from which you navigate to our Website, the web search you performed that led you to our Website, social media profile information, purchasing history, and whether you clicked on any of our online advertisements. This information is collected via third-party cookies and similar technologies, such as web beacons (also known as tags or pixels) that Adobe Analytics sets on your web browser. We use this information to manage our online content, improve the performance of our Services, and conduct targeted advertising campaigns. Please review Adobe’s Privacy Policy for additional information on how Adobe Analytics uses the information collected. To prevent your data from being used by Adobe Analytics, you may opt out here.

    Temptu will also use the personal information we collect as described in this section to comply with the law, to efficiently maintain our business, and for other limited circumstances as described in HOW WE SHARE YOUR PERSONAL INFORMATION.

    1. HOW WE SHARE YOUR PERSONAL INFORMATION
    A General Sharing
    Temptu shares personal information in the following instances:
    • Within Temptu. We share your personal information within Temptu for the legitimate business purposes of efficiently and effectively providing the Services, such as accounting and customer service support. Access to your personal information is limited to those on a need-to-know basis.
    • In the event of a corporate reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We will also share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.
    • For legal purposes. We share your personal information where we are legally required to do so, such as in response to court orders, governmental/regulatory bodies, law enforcement or legal process, including for national security purposes. We may share your information with our legal advisors or auditors to establish, protect, or exercise our legal rights or as required to enforce our terms of service or other contracts or to defend against legal claims or demands. We also share this information with third parties as necessary to: detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; to comply with the requirements of any applicable law; or to comply with our legal obligations.
    • With your consent. Apart from the reasons identified above, we may request your permission to share your personal information for a specific purpose. We will notify you and request consent before you provide the personal information or before the personal information you have already provided is shared for such purpose. You may revoke your consent at any time with effect going forward.
    • GENERAL INFORMATION CHOICES

          You have the following choices with respect to your personal information:

            • Correct or view your personal information. You may access your Temptu account profile to correct or view certain personal information of yours in our possession and which is associated with your profile.
            • Opt-out of marketing communications. You may opt-out of receiving marketing emails from us by clicking the “unsubscribe” link provided with each email. Please note that we will continue to send you emails necessary to the Services or any assistance you request.
            • Location settings. You can prevent your mobile device from sharing your location data by adjusting the permissions on your mobile device or browser.
            • Opt Out of Other Cookies. All session cookies are temporary and expire after you close your web browser. Persistent cookies can be removed by following your web browser’s directions. To find out how to see what cookies have been set on your computer or device, and how to reject and delete the cookies, please visit: https://www.aboutcookies.org/. Please note that each web browser is different. To find information relating to your browser, visit the browser developer’s Website and mobile application. If you reset your web browser to refuse all cookies or to indicate when a cookie is being sent, some features of our website may not function properly. If you choose to opt out, we will place an "opt-out cookie" on your device. The "opt-out cookie" is browser specific and device specific and only lasts until cookies are cleared from your browser or device. The opt-out cookie will not work for essential cookies. If the cookie is removed or deleted, if you upgrade your browser or if you visit us from a different computer, you will need to return and update your preferences. By clicking on the “Opt-Out” links below, you will be directed to the respective third-party website where your computer will be scanned to determine who maintains cookies on you. At that time, you can either choose to opt out of all targeted advertising or you can choose to opt out of targeted advertising by selecting individual companies who maintain a cookie on your machine.

                  1. RIGHTS UNDER PRIVACY LAW
                  1. Rights of Individuals in Australia

                    For any functions of the Service that we collect your personal information for our own purposes, individuals in Australia are entitled to certain rights under the Privacy Act and Australian Privacy Principles. If our processing of your personal information is subject to the Privacy Act and Australian Privacy Principles, you are entitled to the following rights:

                    • Right to access. You can request access to your personal information, subject to certain exceptions. Temptu may charge reasonable costs for providing access to your personal information.
                    • Right to correction. If you believe that any personal information Temptu has collected about you is inaccurate, not up-to-date, incomplete, irrelevant or misleading, you may request correction.
                    • Right to lodge a complaint. You can make a complaint to Temptu about our handling of your personal information. To do so, please contact us at the contact information provided in this section setting out the details of the complaint. We will promptly investigate your complaint and respond to you in writing setting out the outcome of our investigation, what steps we propose to take to remedy the complaint, and any other action we will take to deal with your complaint. If you are not satisfied with the outcome of your complaint, you can refer your complaint to the Office of the Australian Information Commissioner.

                  2. Rights of Individuals in Canada

                    For any functions of the Service that we collect your personal information for our own purposes, individuals in Canada are entitled to certain rights under the Personal Information Protection and Electronic Documents Act (“PIPEDA”). If our processing of your personal information is subject to PIPEDA, you are entitled to the following rights:

                    • Right to access. You can request access to your personal information, subject to certain exceptions. Access to the personal information will be provided free of charge, subject to certain exceptions.
                    • Right to correction. If you believe that any personal information Temptu has collected about you is inaccurate, not up-to-date, incomplete, irrelevant or misleading, you may request correction.
                    • Right to withdraw consent. If we process your personal information based on your consent, you may revoke your consent at any time. by emailing us at webmaster@temptu.com. If you withdraw your consent, we will also instruct our processors to end any processing of relevant information that we have shared with them.
                    • Right to file a complaint. Under PIPEDA, you have the right to complain directly to us regarding our alleged noncompliance with PIPEDA. We will review and respond to your complaint. PIPEDA-related complaints can be directed to our Privacy Officer at webmaster@temptu.com.

                    If you are a resident of Quebec, you have some additional rights as described below:

                    • Decisions based on automated processing. If we use your personal information to render a decision based exclusively on automated processing, you have the right to be informed of this at or before the time of the decision.

                  3. Rights of Individuals in Nevada

                    If you are a consumer in the State of Nevada, you may request to opt-out of the current or future sale of your personal information. We do not currently sell any of your personal information under Nevada law, nor do we plan to do so in the future. However, you can submit a request to opt-out of future sales by contacting us at customercare@temptu.com. Please include “Opt-Out Request Under Nevada Law” in the subject line of your message.

                    • DO NOT TRACK. We do not recognize “Do Not Track” requests for internet browsers. Do Not Track is a preference you can set to inform websites and applications that you do not want to be tracked.
                    • INFORMATION SECURITY. We implement appropriate technical and organizational security measures, such as access controls and encryption, to protect the personal information that we collect and maintain from unauthorized access, destruction, use, modification, or disclosure. However, no security measure or modality of data transmission is 100% secure, and we are unable to guarantee the absolute security of the personal information we have collected from you.
                    • CHANGES TO THIS PRIVACY NOTICE. We may amend this Privacy Notice in our sole discretion at any time. If we do, we will post the changes to this page, and will indicate the date the changes go into effect. We encourage you to review our Privacy Notice to stay informed. If we make changes that materially affect your privacy rights, we will notify you by prominent posting on the Website and/or via email, and obtain your consent, if required.
